All My Sons movers have not complied with a mediation agreement. What should I do next?
Absolutely a small claims case is prudent and your duty to hold them accountable. I operate a moving company and frequently see the results of these rogue or unskilled movers. If you have already signed a binding settlement limiting your compensation on your claim, then file the case for that amount. I would also recommend filing a report with AMSA (American Moving and Storage ociation) and the BBB where they are located. If you did not specify in your own handwriting PRIOR to your move that you accepted the $0.60 per lb per item base valuation, then they cannot limit their liability to this amount and you could potentially seek the real damages.
